Please read these Terms carefully before using Guitar Mind. By accessing or using the service you agree to be bound by them. If you do not agree, do not use the service.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and the Service Provider named in Section 2 ("we", "us", "our") governing your access to and use of the Guitar Mind website and application (the "Service"). These Terms also serve as the terms and conditions for providing services by electronic means (regulamin świadczenia usług drogą elektroniczną) under Polish law. By creating an account or otherwise using the Service, you represent that you are at least 13 years old (16 in the EU/EEA) and have the legal capacity to enter into these Terms. Purchasing a paid plan requires you to be an adult or to have the consent of a parent or legal guardian.
2. Service Provider
The Service is provided by:
Adam Mieczysław Węgrzyn
Poland
Email: adam@guitar-mind.com
The Service Provider is a natural person carrying out działalność nierejestrowana (unregistered business activity) under Article 5 of the Polish Entrepreneurs' Law of 6 March 2018 (Prawo przedsiębiorców).
- No registry numbers. Unregistered activity is not entered in CEIDG, so the Service Provider has no NIP or REGON assigned for this activity.
- VAT. Sales are exempt from Polish VAT under Article 113 of the Polish VAT Act (subjective exemption), so no VAT is charged.
- Invoices. A bill (rachunek) or invoice is issued on request — email us with the payment details.
- Payments. Payments are processed by Stripe as an external payment provider.
- Your rights are unaffected. The Service Provider's legal form does not limit any of your rights as a consumer; you have the same rights as when buying from a registered business.
- Future transition. If the statutory limits for unregistered activity are exceeded, or business needs require it, the Service will be transferred to a registered business. We will update these Terms and notify subscribers by email before that happens.
3. Description of Service
Guitar Mind is an interactive app that teaches how the guitar fretboard works through practice with shapes and interval training, and tracks your progress over time. The Service is provided via a web browser (and, where available, native app wrappers). A free plan gives access to a limited set of practice content; full access requires a paid subscription (see Section 5). The product is in active early-access development: we may add, change, or remove features, and we will give reasonable notice before removing anything that paid subscribers rely on.
Technical requirements. To use the Service you need a device with an internet connection, an up-to-date web browser (current versions of Chrome, Safari, Firefox, or Edge) with JavaScript and cookies enabled, and an email address or Google account to sign in. Sound modes require working audio output.
You must not provide content that is unlawful through the Service.
4. User Accounts
To access the Service you must register for an account (email/password or Google Sign-In). The account agreement is concluded when registration is completed and lasts until it is terminated (see Section 12). You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your password and not share it with others.
- Notify us immediately at adam@guitar-mind.com of any unauthorised use of your account.
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Plans, Billing & Cancellation
- Free plan. The free plan is free of charge and gives access to a limited part of the practice content.
- Paid plan. The paid plan (currently "Early Access") unlocks full access to the Service. It is billed monthly, in advance, at the price shown on the pricing page and at checkout. The subscription agreement is concluded when your first payment is confirmed, and renews automatically each month until cancelled.
- Price lock. If we raise the price for new subscribers, your existing subscription keeps the price you signed up at for as long as you remain continuously subscribed.
- Payment processing. All billing runs through Stripe. We do not store your full payment card details on our servers; by subscribing you also agree to Stripe's own terms.
- Cancellation. You can cancel any time from Settings in the app (via the Stripe customer portal) or through links in Stripe billing emails. Cancellation stops future renewals; you keep access until the end of the period you already paid for.
- Refunds. Apart from the right of withdrawal in Section 6 and refunds due under a complaint (Section 7), payments for billing periods that have already started are not refunded.
- Confirmation. After each payment you receive a confirmation by email, together with a link to these Terms.
6. Right of Withdrawal (Consumers)
If you are a consumer, you have the right to withdraw from the subscription agreement within 14 days of the day it was concluded (the day your first payment was confirmed), without giving any reason, under the Polish Consumer Rights Act of 30 May 2014 (ustawa o prawach konsumenta).
- How to withdraw. Send us a clear statement by email to adam@guitar-mind.com, before the 14-day period ends. You may use the model form below, but it is not required. We will confirm receipt by email.
- Refund. We will refund the full subscription payment you made for that agreement no later than 14 days after receiving your statement, using the same payment method, at no cost to you. Your access to paid content ends when the refund is issued.
- Later renewals. The right of withdrawal applies to the subscription agreement, not to each monthly renewal. After the 14-day period you can still cancel at any time to stop future renewals (Section 5).
Model withdrawal form (complete and return only if you wish to withdraw):
To: Adam Mieczysław Węgrzyn, adam@guitar-mind.com
I hereby give notice that I withdraw from my contract for the provision of the following service: Guitar Mind paid subscription.
Concluded on: ____________
Name of consumer: ____________
Email address used for the account: ____________
Address of consumer: ____________
Date: ____________
7. Complaints
We are responsible for the Service being in conformity with the contract, as required by the Polish Consumer Rights Act (Chapter 5b, provisions on digital content and digital services). If something does not work as it should, you can file a complaint:
- How. Email adam@guitar-mind.com with your account email, a description of the problem, and what you would like us to do.
- Response time. We respond within 14 days of receiving the complaint. If you are a consumer and we do not respond within that time, your complaint is considered accepted.
- Remedies. If the Service is not in conformity with the contract, you may ask us to bring it into conformity; if we cannot do so, or do not do so within a reasonable time, you may ask for a price reduction or withdraw from the contract, as provided by law.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to probe, scan, or test the vulnerability of any Guitar Mind system or network.
- Reverse-engineer, decompile, or disassemble any part of the Service except as permitted by applicable law.
- Scrape, crawl, or systematically extract data from the Service without our prior written consent.
- Use automated tools (bots, scripts) to access the Service in a manner that burdens our infrastructure disproportionately.
- Impersonate another person or entity, or falsely state your affiliation.
- Upload or transmit viruses, malware, or other harmful code.
- Attempt to gain unauthorised access to other users' accounts or data.
- Share your account or subscription access with people it was not purchased for.
9. Intellectual Property
Guitar Mind and all of its content — including but not limited to the software, fretboard logic, training algorithms, UI designs, graphics, text, logos, and overall look and feel — are the sole and exclusive property of Adam Mieczysław Węgrzyn ("the Creator") and are protected under the Polish Act on Copyright and Related Rights of 4 February 1994 (Ustawa z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych), applicable EU directives, and other international intellectual property laws. These rights arise automatically upon creation and do not require registration.
The "Guitar Mind" name and logo are additionally protected as trademarks; a trademark application covering the name and logo has been filed with the Polish Patent Office (Urząd Patentowy RP).
The unique logic, pedagogical methodology, and design patterns embodied in this Service represent original creative and technical work authored by the Creator. No third party has any right, title, or interest in these elements.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Service solely for your personal, non-commercial educational purposes, for as long as your account remains active. You may not reproduce, copy, distribute, sell, sub-licence, reverse-engineer, decompile, or create derivative works from any part of the Service without the prior written permission of the Creator, except where applicable law expressly allows it.
Any feedback, suggestions, or ideas you submit may be freely used by the Creator without compensation or attribution to you.
10. Disclaimers & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT PERMITTED BY LAW, ADAM MIECZYSŁAW WĘGRZYN (THE "CREATOR"), AS AN INDIVIDUAL DEVELOPER, MAKES NO REPRESENTATION THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
THE SERVICE IS AN INDEPENDENT PERSONAL PROJECT, CURRENTLY IN EARLY ACCESS. IT IS NOT AFFILIATED WITH, ENDORSED BY, OR SUPPORTED BY ANY COMPANY, EMPLOYER, OR INSTITUTION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE CREATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, NOR FOR ANY LOSS OF REVENUE, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE. FOR USERS WHO ARE NOT CONSUMERS, THE CREATOR'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) EUR 10.
Consumers. Nothing in these Terms excludes or limits the Creator's liability for damage caused intentionally or through gross negligence, or any liability towards consumers that cannot be excluded or limited under applicable law — including liability for the conformity of the Service with the contract (Section 7) and your statutory rights under the Polish Consumer Rights Act.
11. Indemnification
To the extent permitted by law, you agree to compensate the Creator for any third-party claims, liabilities, damages, losses, and reasonable costs arising out of your breach of these Terms or your violation of any third-party rights, in each case only where you are responsible for that breach or violation.
12. Termination
You may delete your account at any time from Settings in the app, which terminates the account agreement with immediate effect. Deleting your account permanently removes your sign-in and cancels any active subscription; identifying details — your username, handle, and email — are replaced with a neutral placeholder. Your practice history (sessions, statistics, and unlocks) is kept in this anonymised form rather than deleted, so it can no longer be linked back to you. See our Privacy Policy for details, or contact us at adam@guitar-mind.com if you have questions.
We may suspend or terminate your access to the Service if you seriously or repeatedly breach these Terms, after notifying you by email and, where the breach can be remedied, giving you a reasonable time to stop it. If we terminate a paid subscription for reasons other than your breach, we will refund the unused part of the current billing period. Sections 9, 10, 11, and 13 survive termination.
13. Governing Law & Disputes
These Terms are governed by the laws of Poland, including the Polish Civil Code of 23 April 1964 (Kodeks cywilny), the Consumer Rights Act of 30 May 2014 (ustawa o prawach konsumenta), the Act on Providing Services by Electronic Means of 18 July 2002 (ustawa o świadczeniu usług drogą elektroniczną), and, where applicable, GDPR (RODO).
If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence, and disputes will be heard by the court competent under general rules — including the courts of your country of residence. For users who are not consumers, disputes are subject to the courts competent for Kraków, Poland.
Consumers in Poland may also use out-of-court complaint and redress procedures, for example through a municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów) or a permanent consumer arbitration court at a Provincial Inspectorate of Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej). Using these procedures is voluntary for both parties. More information is available at prawakonsumenta.uokik.gov.pl.
14. Changes to Terms
We may update these Terms for important reasons, such as changes in the law, changes to the Service, or changes to how the Service is operated (for example, moving to a registered business). We will notify registered users by email at least 14 days before material changes take effect and update the "Last updated" date above. If you do not accept the changes, you can cancel your subscription or delete your account before they take effect; changes do not apply to billing periods you have already paid for.
